This Policy is related to the MOBE Website, the MOBE Digital Health mobile application, hosted by or on behalf of MOBE, and the related features, including guided health services, including the chat feature, general and customized content, Medication review, etc. (collectively, the “MOBE Services” or “Services”).
NOTE TO RESIDENTS OF MINNESOTA, NEBRASKA, AND TEXAS. PLEASE SEE SECTION 16 AT THE BOTTOM OF THIS POLICY FOR ADDITIONAL TERMS THAT MAY APPLY TO YOU.
This Policy is being provided to you on behalf of MOBE, LLC and its affiliates (“MOBE,” “we”, “us,” “our”). MOBE provides Services in combination with online and mobile services, including, but not limited to the MOBE Website (“mobeforlife.com” or the “Website”), widgets, computer programs and the MOBE Digital Health mobile application (“App”), hosted by or on behalf of MOBE. The App enables MOBE to enhance a consumers’ engagement in their own general health and wellness which may include the use of wearable, like Apple Watch, Fitbit, etc., and non-wearable devices, like your cell phone (“Devices”). The App may be offered as part of a MOBE Service by MOBE on its own behalf and/or on behalf of a sponsoring organization, including, but not limited to your health plan, employer, provider, medical device manufacturer, Accountable Care Organization, (“Sponsor”). MOBE is the owner and operator of the Website and the App and does not provide healthcare services.
If your Sponsor is supporting your use of the MOBE Services, any Personal Information that you provide to MOBE is considered Protected Health Information (or PHI) and we will safeguard it in accordance with all applicable state and federal requirements regarding the privacy and security of health information. “Personal Information” for purposes of this Policy means information, alone or in conjunction with other information, that identifies, or reasonably may be used to identify, you, including, but not limited to, your name, address, phone number, or email address. “Protected Health Information” or “PHI” includes any individually identifiable information that we obtain from you or others that relates to your past, present, or future physical or mental health, the health care you have received, or payment for your health care. Please note that this Policy is distinct from a Notice of Privacy Practices, which you may have received from your Sponsor. A Notice of Privacy Practices is a special notice required by a federal privacy law known as “HIPAA”.
If your use of the MOBE Services is not sponsored by your Sponsor, you understand that information you provide to MOBE will not be protected under HIPAA. However, there may be specific features or aspects of the Website, App or Services that relate to information governed by HIPAA. In such instances, you may be presented within the Website or App or otherwise with patient directives or HIPAA authorizations that direct or allow medical providers or your health plan or employer to share information with MOBE. Such information will be collected, used, and shared by MOBE as stated in such directives and authorizations, and in the event of any conflict between the terms within those directives and authorizations and this Policy, the terms in your directives and authorizations shall supersede and control over the terms in this Policy.
MOBE respects your privacy, and we are committed to protecting it through compliance with this Policy. This Policy explains how we handle the Personal Information we collect or that you may provide when you download, install, register with, access or use the Website or the App, including the Services, and how we use and disclose that information. This Policy also describes the risks of using electronic communications and electronic storage of your health information.
This Policy applies to information we collect through the Website or in the App, including through a Device (whether supplied by MOBE, a third-party or you, the user) or through any other application or service that (i) displays, links to, or references this Policy; and/or (ii) is a service offered on or through the App, including the Services, and other services offered by MOBE that are promoted through the App and that involve you contacting MOBE by phone, email, text or chat.
This Policy is also subject to the provisions of the Terms and Conditions, available at https://www.mobeforlife.com/terms-and-conditions which are incorporated herein by reference. Please read this Privacy Policy and the Terms and Conditions carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, you should not use the MOBE Services. By accessing or using the MOBE Services or by clicking to accept or agree to the Policy when that option is made available to you, you accept and agree to be bound and abide by this Policy to the extent that it does not conflict with any applicable Plan Privacy Policies and Law, as defined below.
WE MAY MODIFY THIS PRIVACY POLICY AT ANY TIME, SO CHECK BACK REGULARLY FOR UPDATES. ALL CHANGES WILL BE EFFECTIVE IMMEDIATELY UPON POSTING TO THE WEBSITE. WE WILL ATTEMPT TO NOTIFY YOU OF ANY MATERIAL CHANGES VIA THE WEBSITE OR THE PLATFORM.
For purposes of this Privacy Policy, “Personal Information” means information that alone or in combination identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. Personal Information does not include publicly available information or aggregated information that does not include personal identifiers.

The Devices work in conjunction with a User Account established on the App. Information may be automatically uploaded to the App through a paired Device depending on the settings that you choose on your Device.
All data entered by you or automatically uploaded from a Device is stored securely on the App and in our systems and the data is encrypted in the App, when stored on our servers and while being transmitted.
In addition, we collect information that you have authorized your Sponsor to provide to us.
Please note, we may combine the Personal Information and other content and information we receive about you from multiple sources, including, without limitation, Personal Information we collect directly from you and one or more Third Party Sources.
MOBE will not use your Personal Information for purposes other than those listed in this Policy unless we obtain your consent first. MOBE uses your Personal Information to:
MOBE will only use or disclose the Personal Information that we collect from or about you—including, without limitation, through the use of Devices—as allowed by applicable state and federal law and, if applicable, the terms of our agreement with your Sponsor and its Notice of Privacy Practices (collectively “Plan Privacy Policies and Law”). Your Sponsor’s Privacy Policies (if applicable) and Law may be more limiting than this Policy. If that is the case, the Plan Privacy Policies and Law control how we may use or disclose your Personal Information. For example, in this Policy we say that we may use your contact information to send you information about opportunities, products or services provided by MOBE—we will only do this if the Plan Privacy Policies and Law allow us to. In addition, if applicable, we will only use or disclose your Personal Information as allowed by your Sponsor’s Privacy Policies and Law. For more information, please refer to your Sponsor’s Notice of Privacy Practices.
MOBE will not sell, rent, transfer, disclose or otherwise permit the use of your Personal Information by advertisers or other third-parties for direct marketing purposes. From time to time, MOBE may send you information about opportunities, products or services provided by MOBE, if permitted by any applicable Plan Privacy Policies and Law.
To operate our Website and provide our Services, we may share Personal Information with certain third parties. The third parties that we may share Personal Information with include:
We use analytics services and targeted advertising cookies in addition to location features that are connected to your use of the Services. We use cookies, web beacons, pixel tags, and other technologies (collectively, “Cookies”) on our Services to automatically collect information that helps us improve the Services and advertise to you. A cookie is a small text file that our Services save onto your computer or device when you use the website.
A cookie can either be a “session” cookie or a “persistent” cookie. Session cookies exist only for so long as you are visiting the website and are typically deleted when you exit your web browser. Each time you visit a website that has implemented a persistent cookie, the cookie is renewed, and it will remain active until its predetermined expiration date.

We use third-party software tools on our Sites to learn more about how visitors navigate the Website and view content. These third-party analytics providers provide us with analytical information collected through the Cookies that we use to improve the Sites, to make sure it is easy to use, and to develop content that is both interesting and customized.
B. Targeted Advertising
We use service providers and other third parties to serve you customized email, SMS, and internet-based advertisements. Those ad networks use cookies and other tracking technologies to serve ads based on your prior visits to our Website. These ad networks may place and store cookies on the devices you use to access our Services and collect information, including your browsing behavior, referring websites, and your response to advertisements.
Pinterest Conversion Tracker: We use the Pinterest Conversion Tracker to help us understand how users interact with our website after viewing or engaging with our ads on Pinterest. This tool allows us to measure the effectiveness of our advertising campaigns and improve the relevance of the content we provide.
The Pinterest Conversion Tracker collects information such as actions taken on our site (for example, completing a purchase or signing up for a newsletter) and may use cookies or similar technologies to track this activity. Data collected through this tracker is used in accordance with Pinterest’s Privacy Policy and is not shared with third parties outside of Pinterest except as required by law.

C. Geolocation Services
An App may utilize location services on your mobile device to collect and use location data, including the real-time geographic location of your device. If you consent to the App’s utilization of location services, we may use GPS, Bluetooth, your device’s unique identifier, and/or your IP address, along with Wi-Fi and cell tower locations and other technologies to determine your device’s geolocation. This location data is utilized to deliver Services requested by you. We do not maintain a history of a device’s location, only its current location at any given moment. We will collect geolocation data only if you consent, and we will notify you whether location services will be running continuously or only when the App is in use. You may choose to disable location services through our App or your mobile-enabled Wi-Fi devices, but if you do so, you will not receive any notifications or services that require geolocation. Most mobile devices provide users with the ability to disable location services. These controls are generally located in the device’s settings menu. You can also contact your mobile Services carrier or your device manufacturer for more information on disabling location services.
Our online Services may use social media plug-ins (e.g., the Facebook “Like” button and “Share to Twitter” button) to enable you to easily interact with certain social media websites (e.g., Facebook, Twitter, Instagram) and share information with others. When you visit our online Services, the operators of the available social media plugins can place a cookie on your device, enabling such operators to recognize individuals who have previously visited our online Services. If you are logged into these social media websites while visiting our online Services, the social media plugins allow the relevant social media website to receive information that you have visited our online Services or other information.
The social media plugins also allow the applicable social media website to share information about your activities with our online Services with other users of the social media website. For example, Facebook Social Plugins allow Facebook to show your “Likes” and comments on our online Services to your Facebook friends. Facebook Social Plugins also allow you to see your friends’ Facebook activity on our online Services. We do not control the content from social media plugins. We may also interact with you on social media platforms. If you contact us on one of our social media platforms, request Services, or otherwise communicate directly with us on social media, we may contact you to interact with you. We utilize the YouTube Application Programming Interface (API) services to enable you to access YouTube content through our Services. Your use of YouTube is governed by YouTube’s Terms of Services and Privacy Policy. We encourage you to read the YouTube Terms of Service and Privacy Policy, which are available on its website at https://www.youtube.com/t/terms.
When you leave our website and go to another linked site, we are not responsible for the content or availability of the linked site. Please be advised that we do not represent either the third party or you, if you enter into a transaction on the third-party site. Further, the privacy and security policies of the linked site may differ from ours.
We may aggregate or de-identify Personal Information we collect through our Services and when operating our business. For example, we may aggregate Personal Information to calculate the percentage of users in a particular zip code. Once information or data has been de-identified and/or aggregated, such information is no longer Personal Information.
From time to time, MOBE may also ask you to participate in surveys designed to help improve MOBE Programs. Any Personal Information provided to MOBE in connection with any survey will be used only in relation to that survey and as elsewhere set forth in this Policy.
Our Services are operated in the United States and intended for users located in the United States. Like almost every website, our website can be accessed by an international audience. If you are located outside of the United States, please be aware that information we collect, including Personal Information, will be transferred to, processed, stored and used in the United States. The data protection laws in the United States may differ from those of the country in which you are located, and your Personal Information may be subject to access requests from governments, courts, or law enforcement in the United States according to laws of the United States. In addition, such data may be stored on servers located outside your resident jurisdiction and in jurisdictions which may have less stringent privacy practices than your own.
California Civil Code Section 1798.83 permits customers of a company who are California residents to request and obtain from us once a year, free of charge, information about the Personal Information (if any) we disclosed to third parties for the third parties’ direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of Personal Information that were shared and the names and addresses of all third parties with which we shared information in the immediately preceding twelve (12) calendar months. Our Services are not intended for use by children under thirteen years of age. We do not knowingly or intentionally collect personal information from individuals under age 13, and the Services are not designed for or directed to children under the age of 13. If you are under 13, please do not attempt to use the website or send any personal information about yourself to us. If we learn that a child under the age of 13 has provided personal information to us, we will promptly delete that information.
We use a combination of firewall barriers, encryption, and authentication procedures, among others, to protect your data and MOBE accounts and systems from unauthorized access.
When you register on the App, MOBE requires you to create a password for your privacy and security. This password or alternative authentication mechanism (Fingerprint or Face ID) is stored in an encrypted format in the App and on our systems.
It is important to understand that these precautions apply only to our App and systems. We exercise no control over how your information is stored, maintained, or displayed by third parties or on third-party sites, except to the extent the sites store or use the data pursuant to a contract to do so on our behalf.
The safety and security of your information also depend on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. If you believe your username or password has been compromised, please change your password immediately and email us at info@mobeforlife.com.
We are not responsible if someone else accesses your account through registration information they have obtained from you or through a violation by you of this Policy or the MOBE Terms and Conditions. If you have a security-related concern, please email info@mobeforlife.com.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted using our App. If you back-up data from your phone, there is a risk that your Personal Information may be backed up and stored elsewhere. By using the App, you agree that you have read, understand, and accept this risk. We are not responsible for circumvention of any privacy settings or security measures contained on the App.
Certain states have passed laws that provide consumers who are residents of those states with certain privacy rights related to their Personal Information. Those states and the rights are summarized below:

Depending on the state in which you live, you may have a right to request that we delete your Personal Information or Personal Data we collected from you or the right to request that we delete all Personal Information or Personal Data we have collected about you. We will comply with such a request and direct our service providers to do the same, subject to certain exceptions permitted by applicable law.
Right to Correct Your Information
Depending on the state in which you live, you may have a right to request that we correct your inaccurate Personal Information or Personal Data. If you request that we correct inaccurate Personal Information or Personal Data about you, we will use commercially reasonable efforts to correct it. If necessary, we may request documentation demonstrating that the information we retained is inaccurate.
Right to Data Portability
Depending on the state in which you reside, you may request a copy of the Personal Information or Personal Data we collected from you or request a copy of all the Personal Information or Personal Data we have collected about you in a portable and, to the extent technically feasible, readily usable format.
Who May Exercise Your Rights. You may only request to exercise your rights on behalf of yourself. A parent or legal guardian may make a request on behalf of their child. If you are a Minnesota, Nebraska, or Texas resident, a person that you authorize to act on your behalf may make a request related to your Personal Information. See the section titled “Authorized Agents” below for more information
Verifiable Consumer Request. In order to verify your request, you must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or Personal Data, and you must describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. To verify your identity, we may ask you to log into your account (if you have an account with us) or provide additional information. Any information you provide will only be used to verify your request. When seeking additional information from you, we may contact you through your account or the contact phone number or email address you provided in your request. If we cannot verify your identity, we may deny your request.
We will only use Personal Information we collect during the verification process for the purpose of verifying your identity. If we are unable to verify your identity as required by applicable laws and regulations, we will decline to comply with your request, and let you know why.
Authorized Agents. Minnesota, Nebraska, and Texas residents may submit a request to opt out through an authorized agent. If you choose to use an authorized agent, you must (a) provide signed permission to that authorized agent to submit requests on your behalf and (b) verify your identity.
We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf.
When We Will Respond. We will try to respond to your request within 45 days. If we require additional time, we will inform you of the reason and extension period. For data portability requests, we will select a format to provide your Personal Information to you. We may charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded.
Right to Non-Discrimination. You have a right to not receive discriminatory treatment for exercising any of your rights. If we choose to offer a financial incentives program in the future, additional terms will apply which may be an exception to this Section. We do not use Personal Information to discriminate against any individual.
Appeal Process. If you disagree with our refusal to take action on your request to exercise your privacy rights, you have the right to appeal that decision. You must submit your appeal request within 60 days of your receipt of our denial. You may submit your request to us by:
